I was looking because I needed to know if I could fight a garnishment of my checking account. I not only can fight but I can also turn the table completely on the debt collection company. Things you need to know. Step by step guidance. if you are served get this book. if you're getting calls get this book. I'm so tired of others taking advantage because of my lack of knowledge. I Wish I would have known about this book 3 years ago when I lost my home. Maybe that would have had a a different outcome as well.

This book gives the ins and outs to suing debt collectors and clearing your name of any old debts. I have not tried any of the processes in the book but Im sure it will definitely help those in debt if given a chance. I finished 3/4s of the book, I will finish it to discover more info and insight.
The book is well written and well-intentioned.But its premise hinges on the hope that debt-holders will not decide to pursue litigation all the way to a judgment, and on claimed legal loop-holes and Achilles heels within the legal system that can be exploited to win a case. Both premises are a dead-end, at least in today's legal world. (I can not speak as to whether the suggested tactics might have fared in the past.)With regard to the claim that most debt-holders will not pursue a case doggedly to the end...Debt-holding has become a major industry, and if a debt-holder has to spend a couple of hundred, or even a couple of thousand dollars litigating a case, they are now likely to do so -- as long as they believe they will make a profit from it in the end.As part of the debt-collection industry there are law firms located in every jurisdiction that, fairly cheaply, will move a case forward on behalf of a debt-holder who is located far away. Also, courts typically will allow depositions to take place over the phone for Plaintiffs who are not local.With regard to legal loopholes... debt holders/debt collectors are not stupid, and neither are lawyers who specialize in debt collection law.I am not saying that loopholes have not existed in the past, but you can be sure that that both debt holders/collectors and their lawyers are well funded and politically well-organized, and it is a safe bet that they collectively lobby legislators to remove any legal loopholes that might have existed in the past, or that might come up that a debtor might hope to exploit.So for example, do not expect to prevail because a credit card company does not have a signed agreement with you with your name on it -- because the use of the card is taken as proof that you have agreed to accept a debt.And don't think that debt owners/collectors/attorneys will not go to the trouble to get copies of every billing statement ever sent to you, because it is simply too easy to gather that information electronically any more; it is no longer a hassle or problem to obtain. (Again, back in the day of paper records and fax machines maybe things were different.)Here's what you can expect...1. Expect a local attorney to file paperwork and show up for court hearings.2. Expect the Plaintiff, or Plantiff's representatives, to provide every billing statement ever sent to you -- which has a wealth of case law supporting the idea that if you have a history of receiving prior statements and making payments -- that the debt is yours.3. Expect to spend countless hours preparing legal documents in your defense.4. Expect to pay hundreds and hundreds of dollars in fees filing Defendant paperwork with the court.4. And at the end of it all, expect to lose.I did it all. I went through it all. The advice provided within the book, regrettably, does not work; at least not in today's world.
